Agile Talent Community Application Platform User Terms (UT)

Please read these UT carefully. Use of this Website by you indicates that you accept these UT. If you do not accept these terms, do not use this Website.

 

1. Using the Website

1.1 This Website (grantt@tribepad.com or the Website) is provided by Grant Thornton UK LLP (we/us) a limited liability partnership in accordance with the Limited Liability Partnerships Act 2000 (with registered number OC307742 and registered office at 30 Finsbury Square, London EC2A 1AG). 1.2 The Grant Thornton Agile Talent Community will be made up of a variety of individuals at differing stages in their careers. This may include, newly qualified or individuals early in their careers seeking a variety of paid work alongside pursuing own interests for example setting up own business or travelling. Similarly, those who have self-funded or chosen to stop studying could join the Community. Working parents seeking more flexibility in their work and family life may also form part of the community along with individuals who have built successful careers and held leading roles within organisations, but are now seeking more flexibility in their lifestyle and the ability to embrace a variety of roles for challenge and excitement.

1.3 The Website is the Agile Talent Community resource management site which should include ‘making individual application(s) to Grant Thornton’s Agile Talent Community‘ (the Purpose), and managing the active talent.

1.4 Access to the Website is subject to these UT.

1.5 When you register to use the Website you will be asked to create a password.

1.6 Once registered, your email address and the password will give you access via the Internet to the Website.

1.7 By proceeding to use this Website you agree to:

      1.7.1 the UT;

      1.7.2 our privacy policy available at https://www.grantthornton.co.uk/en/privacy/ (Privacy Policy); and

      1.7.3 our cookies policy available at https://www.grantthornton.co.uk/en/privacy/cookies/ (Cookie Policy)

1.8  All material accessible on the Website is protected by copyright. You may view Website pages on screen and you may print or download extracts for your own personal use. No part of the Website may be reproduced, transmitted to, or stored on any other Website or in any other form of electronic medium without our express written consent.

1.9 We do not warrant that the Website will continue uninterrupted or without delay or that it will remain unchanged. In particular, we reserve the right to bring the Website down as and when we consider the same to be necessary or desirable for the purposes of maintenance.

1.10 If we in our sole discretion consider that you are in breach of any of the UTs then we may take such action as we, in our sole discretion, consider appropriate. This may include (but shall not be limited to), the editing or deletion of any material appearing on the Website or the termination of your rights of access to the Website You will not be entitled to any credit or compensation for any loss of access to the Website which results from any such action taken by us under these UT.

1.11 You accept that we give no undertaking to you that we will take any action to ensure compliance with the UTs by any other user and that we are entitled to take such action as we consider appropriate under the UTs or to refrain from doing so at our absolute discretion.

1.12 Whilst we do not have any obligation to monitor the Website we reserve the right to prohibit activities which in our absolute judgement may cause harm of any kind to other users, our clients, third parties, the Website or us.

1.13 Participation in the Grant Thornton Agile Talent Community and the Website  does not guarantee you any work and we are under no obligation to offer any work to you. For the avoidance of doubt, the selection of individuals to provide work for us shall be at our sole discretion.

2. Licence and Permitted Use:

2.1 We hereby grant you a non-exclusive, non-sub-licensable, non-transferable licence to use the Website in accordance with the Purpose.

2.2 You must not share your username or password to this Website with anyone else.

2.3 You will be responsible for all activities that occur or are submitted under your login details. You shall inform us of any unauthorised access to this Website as soon as you become aware of it.

2.4 You should only post your own details and CV to this Website, and should not apply for any vacancy on behalf of another person.

2.5 You must always ensure that you use the Website fairly which means that you must act reasonably in the way that you print, store, download or share contents of the Website. Note the information in the Website is confidential.

2.6 You may not, and you may not assist or allow a third party to:

      2.6.1 attempt to reproduce, assign, resell, copy, reverse engineer, modify, reuse, disassemble, decompile transfer or make any derivatives of the Website;

      2.6.2 remove or alter any proprietary notices or marks on the Website;

      2.6.3 access all or any part of the Website in order to create any product or services which competes with the Website;

      2.6.4  circumvent any security measures or technical limitations of the Website;

      2.6.5 licence, sell, rent, lease, transfer, assign, distribute, display, disclose, download or otherwise commercially exploit or otherwise make use of the Website to any third party;

      2.6.6 take any screen-shots of the contents or pages of this Website; or

      2.6.7 use the Website for any unlawful purposes, in an unlawful manner or in any way that may bring us into disrepute.

3. Data Protection:

3.1  Any personal data you provide will be treated in confidence and processed in line with our Privacy Policy and applicable data protection legislation in the UK, including the EU General Data Protection Regulation (GDPR), the Data Protection Act 2018 and following any exit from the EU by the UK the United Kingdom General Data Protection Regulation (UK GDPR). 3.2 We will process your personal data for legal, personnel, administrative and management purposes, this includes any special categories of personal data (defined as race or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, physical or mental health, genetic data, biometric data, sex life or sexual orientation) or criminal records you provide to us or our trusted suppliers to protect our, yours and others interests, such as ensuring a safe place of work, equality of opportunity or treatment of workers and occupational health purposes.

3.3 If you have not logged into your account or made a job application for a six month period, you may be contacted and asked if you would like to retain your profile.  You may request your account and personal data be deleted at any time by contacting us at AgileTalentSuppor@uk.gt.com.

4. Disclaimer

4.1 The Website is provided on an “as is” basis and we do not make any representations or warranties, including without limitation, representations or warranties relating to the timeliness, currency, continuity, accuracy, completeness, merchantability, or fitness for a particular purpose of the Website. 

4.2 You acknowledge that no component of the Website shall constitute any financial, legal, investment or any other professional advice.

4.3 Access to the Website is granted to you for the purposes set out in Clause 1.3.

4.4 We will take reasonable steps to not deliberately nor negligently introduce viruses, worms, bombs, Trojan horses and trap doors to the Platform. To the fullest extent permitted by law, we will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website.

4.5 We shall not be liable for any loss caused in whole or in part by your use of the Website, including loss of profit, loss of revenue or opportunity, or any punitive or exemplary damages, whether or not the likelihood of such could have been reasonably contemplated.

4.6 Whilst every effort is made to ensure the material include on this Website is correct, reputable and of high quality, we will not be responsible for any errors or omissions or for the results obtained from the use of such information, or for any technical problems you may experience with the website. If we are informed of any inaccuracies in the material on the Website, we will attempt to correct the inaccuracies as soon as we reasonably can.

4.7 By submitting your details, you agree that you are solely responsible for the form, content and accuracy of any CV or information submitted to us and you warrant that all information submitted is true and accurate. You should check carefully the details provided by you on registration and advise us of any inaccuracies or changes that subsequently arise as this could have an impact on recruitment decisions.

4.8 Nothing in the UT shall exclude or limit our liability to you where it would be unlawful to do so.

5. Uploading content onto the Website:

5.1 Whenever you make use of a feature that allows you to upload any information to our Website, you must comply with the content standards set out in clause 5.2.

5.2 Your Assessment Input must:

      5.3.1 be accurate;

      5.2.2 comply with the laws of England and Wales;

      5.2.3 not be defamatory;

      5.2.4 not promote unlawful violence;

      5.2.5 not infringe any copyright, database right, trademark or any other third party rights;

      5.2.6 not breach data protection legislation or confidentiality rights;

      5.2.7 not deliberately nor negligently introduce viruses, worms, bombs, Trojan horses and trap doors; or

      5.2.8 not be in contempt of court.

6. Third Party Claims:

6.1 If you are notified by a third party that your use of the Website infringes the rights of a third party you agree to (i) notify us as soon as reasonably possible; and (ii) at our request immediately cease to use any element of the Website that allegedly infringes third party rights.

7. General

7.1 Change to these Terms: We may amend these terms from time to time. Every time you wish to use the Website, please check these terms to ensure you understand the terms that apply at that time. We will endeavour to give you notice of any material changes to these terms.

7.2 Governing Law: These terms shall be governed by English law and the English courts shall have exclusive jurisdiction.
